GENERAL TERMS AND CONDITIONS

  1. BACKGROUND

1.1

These general terms and conditions (the “General Conditions”) apply when you as a consumer (the “Customer”) place an order via www.kastelshoes.com (the “Website”). The agreement is concluded between you and Kastel AS, company org. no. 999 537 839. Detailed contact information and other information about Kastel AS are set forth on the Website. The General Conditions are only applicable for Customers that are consumers.

 

1.2

Kastel AS is not responsible for any information by third parties provided for on the Website.

 

1.3

The Website and all its content is owned by Kastel AS or its licensors. The information is protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout and information about products, services and other content may not be copied or used without the prior written consent of Kastel AS.

 

  1. CONTRACTS AND ORDERS

2.1

In order to place an order through the Website, the Customer must accept the General Conditions (eg Vilkår). By accepting the General Conditions, the Customer undertakes to comply with the General Conditions in its entirety and acknowledges that he/she has read the information on personal data and cookies and consents to the use according to Kastel’s Privacy Policy set forth here.

 

2.2

A purchase agreement is concluded when Kastel AS has confirmed the Customer’s order and the Customer has received an order confirmation from Kastel AS via e-mail. Kastel AS encourages the Customer to save the order confirmation for any future contacts with Kastel’s customer service regarding the order. The Customer is entitled to cancel its order up until it has been confirmed by Kastel AS. If the order is cancelled, Kastel AS will refund any payments the Customer or its pay- or credit card company has made with regard to the order.

 

  1. CUSTOMER DATA ETC.

3.1

When you visit kastelshoes.com and conduct a purchase, Kastel AS processes your personal data in order to provide the best site possible for you and to complete the purchase agreement. You confirm that the information you entered is accurate and complete and that any inaccurate or incomplete information is your responsibility. Information regarding Kastel AS's processing of personal data can be found in Kastel AS's Privacy Policy.

 

3.2

The Customer undertakes to ensure that no one, except the Customer, uses the Customer’s log-in details. The Customer may not disclose its username or password to any person and shall ensure that any documentation with information about username and password is kept in such a way that unauthorized persons may not access the information. The Customer shall notify Kastel AS without delay if it may be suspected that any unauthorized person has obtained access to the Customer’s password. The Customer is responsible for all purchases made with the Customers log-in details if the Customer has not provided such notification.

 

3.3

If Kastel AS suspects that the Customer abuses its user account or its log-in details or otherwise violates the General Conditions, Kastel AS is entitled to block the Customer’s access to its user account. Kastel AS is furthermore entitled to assign new log-in details to the Customer.

 

  1. PRICES, FEES AND PAYMENT

4.1

The prices stated on the Website apply to orders placed on the Website. All prices are presented in NOK and include VAT. The prices do not include payment- and shipping fees, which are given separately.

 

4.2

The Customer can pay for its purchase in the manner specified on the Website. Kastel AS is entitled to charge the Customer already in connection with the order, unless invoicing or any similar payment method has been selected by the Customer and approved by Kastel AS. Upon invoicing or partial payment, Kastel AS or its partners may obtain a third party credit report. In such a case you will be informed accordingly. Kastel AS reserves the right not to offer all payment methods at all times, alternatively change payment method if the payment method the Customer has selected does not work, for whichever reasons, at the time of fulfilment of the order. Please note that limitations of available payment methods are set forth on the Website.

 

  1. SPECIAL OFFERS

Kastel AS may from time to time provide special offers on the Website which may have more favourable conditions than those set forth in these General Conditions, e.g. with regard to payment or extended right of withdrawal. Such conditions will apply for the duration of the special offer and for the specific products set forth by Kastel AS in connection therewith. Kastel AS reserves the right, at any time, to withdraw such special offers. Upon termination or withdrawal of a special offer, these General Conditions shall apply without any amendments. Any offers on specific products on the Website are valid only for a limited period of time and until products are sold out.

 

  1. DELIVERY AND SHIPPING

6.1

Products in stock are normally delivered within the number of working days set forth on the Website. Unless otherwise agreed (e.g. in connection with reservation of products not in stock), delivery will be made no later than 30 working days after Kastel AS has confirmed the order in writing through the order confirmation. Further information about Kastel’s delivery of products and the conditions for delivery are set forth here.

 

6.2

The expected delivery time is set forth in the order confirmation, at the checkout and/or on the current product page on the Website. Unless otherwise expressly agreed and if a delivery is delayed for more than 30 working days and it is not due to you as Customer, you are entitled to cancel the purchase.

 

6.3

If any package shall be picked up at a specific delivery point, the Customer shall do so within the time specified in the notification. Packages shall normally be retrieved personally with valid identification and order number. The Customer will receive a notification of delivery stating when and where the package shall be picked-up or received. The notification may be made by e-mail, ordinary mail and if the Customer has provided a mobile number, also by phone or SMS. Kastel AS is entitled to charge the Customer a fee of 150NOK if the package is not retrieved.

 

  1. RIGHT OF WITHDRAWAL

7.1

When purchasing products on the Website the Customer has a 14 day withdrawal period in accordance with applicable consumer protection legislation. This means that the Customer has the right to cancel any purchase by notifying Kastel AS accordingly within 14 days from when the Customer or its representative received the product ordered (withdrawal period).

AND COMPLAINTS

8.1

Some of Kastel’s products may be subject to warranties. Information about any warranty period and special conditions for warranties for each product respectively, is set forth on the Website or in these General Conditions. Warranties for products will only cover original manufacturing defects and accordingly not any fault arising upon or after any individual changes of the product’s function and appearance, e.g. rebuilding, upgrading or other configuration of the product. The Customer’s order confirmation constitutes the certificate of warranty.

 

8.2

The right to file a complaint apply to products which are defective according to applicable consumer protection legislation. Any Customer who wishes to assert their right to file a complaint for any product ordered shall contact Kastel AS, as soon as possible after the defect was discovered, using the contact information set forth on the Website.

 

8.3

Kastel AS will carry the cost for the return freight for any approved complaints, given it is return in an agreed upon matter. See our Return Policy for more information.

 

8.4

Once a product, for which a complaint has been filed, is returned and the complaint approved, Kastel AS will refund the Customer in compliance with applicable consumer protection legislation. Kastel AS reserves the right to refuse any complaint if the product, in compliance with applicable consumer protection legislation, proves not to be defective. Upon complaints Kastel AS complies with the guidelines provided by the National Board for Consumer Complaints or the corresponding authorities in other European countries.

 

  1. LINKS

Kastel AS may provide links to other websites beyond the control of Kastel AS and websites beyond the control of Kastel AS may provide links to the Website. Even if Kastel AS attempts to ensure that Kastel AS only provides links to websites which applies similar personal data- and security provisions pursuant to Kastel’s Privacy Policy, Kastel AS is not responsible for any protection or confidentiality of information or personal data which the Customer provides on other websites. The Customer should be cautious and read the personal data provisions applicable to the actual website.

 

  1. FORCE MAJEURE

Kastel AS is not liable for any delays caused by circumstances beyond Kastel’s control, e.g. general labour dispute, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in relief from damages and other measures. If any such situation should arise, Kastel AS shall inform the Customer accordingly both at the beginning and the end of the period for the current situation. If the situation has lasted for more than two months, both the Customer and Kastel AS are entitled to terminate the purchase with immediate effect.

 

  1. CHANGES TO THE GENERAL CONDITIONS

Kastel AS reserves the right to change these General Conditions at all times. Any changes to these General Conditions will be posted on the Website. Changes will become valid once the Customer has accepted the General Conditions (in connection with a new purchase or while browsing the Website), alternatively 30 days after Kastel AS has informed the Customer of the changes. However, Kastel AS recommends that the Customer regularly remains updated on the Website in order to become aware of any changes to the General Conditions.

 

  1. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable by any competent court, authority or arbitral tribunal, the remainder of that provision and all other provisions will remain valid and enforceable to the fullest extent permitted by applicable law. Any provisions determined invalid or unenforceable will be substituted by relevant legal guidance and advice.

 

  1. APPLICABLE LAW AND DISPUTE RESOLUTIONS

13.1

Any disputes shall primarily be settled by agreement after discussions with Kastel’s customer services.

 

13.2

If a dispute cannot be resolved through discussion with Kastel AS's customer service, you, as the customer, can directly submit complaints online via The Consumer Complaints Committee (Forbrukerklageutvalget) directly via the webpage https://www.forbrukerradet.no/klageguide/.

Any disputes are regulated by the Norwegian law, with the venue Oslo District Court (Oslo Tingrett). Under the right of withdrawal, you must state "where applicable", the out-of-court complaint and compensation scheme "you are affiliated with," and the procedure for accessing it.

 

13.3

Disputes concerning the interpretation or application of these General Terms shall be settled as determined under item 13.2, above, or ultimately by the courts.

 

These conditions were established by Kastel AS on Okt. 28th 2019.

 

PLEASE NOTE! Nothing in these General Conditions affects a Customer’s mandatory statutory rights under applicable local laws, to the extent that such rights apply to such Customer and cannot be limited or excluded.

Our goal is to diligently follow all the rules and regulations regarding the protection of your personal data. This policy outline is designed to help you in a variety of ways; such as clarifying which information we gather and how that information is used.

WHICH PERSONAL DATA DO WE USE?

The information we process about you varies slightly depending on whether you are an unregistered customer who is casually surfing and shopping or if you created an account and are thus a registered user. Below, you can read more as to what each category entails.

 

INFORMATION ABOUT YOU AS A CUSTOMER

To handle your orders and purchases, we require the following information about you;

  • Address, phone number and e-mail
  • Date of birth* (for some payment methods*)
  • Payment information and payment history
  • Information about your order (for ex: order number, product(s), delivery address, and invoice)

We do this with the legal obligation for completion of your Purchases; without which, we would be unable to complete our transaction with you. You may choose to withdraw your consent at any time and to have your data deleted.

“Save for my next payment” option

If you consent by choosing the "Save for my next payment” option, we'll save your card information for future safe purchasing, with your consent. You can withdraw your consent at any time.

In order to comply with the rules and regulations to which we must adhere, we require the following information about you;

  • Name
  • Address
  • Payment information and payment history
  • Information about your order (for ex: order number, product(s) and delivery address)

We do this to comply with legal obligations; that is to comply with the laws to which we must adhere. The Book-keeping Act is one example as to why we save this information (with limited access) for 5 years, in addition to the current year.

 

Data required for customer service purposes

In order to provide you with customer service, we require the following information about you;

  • Name
  • Phone number and e-mail
  • Date of birth (for some payment methods e.g. Klarna)
  • Payment information and payment history
  • Information about your order (for ex: order number, product(s), delivery address, and invoice)
  • Information you personally provide during your communication with us

We do this with the legal obligation of processing in a way that is necessary to cater to both our and your legitimate interests, in order to answer any questions you may have.

 

Data required to offer you a personalized site

In order to offer you a personalized site which provides the best possible shopping experience, that is with optimally relevant product representation and recommendations, we require the following information about you;

  • IP
  • Data gathered by cookies and the like. For example, on which products you clicked and your shopping history

We then analyse this data and provide you with product recommendations for other (similar) products on our site in which you may be interested. We do this with your consent provided via the cookie-banner on our site. This data is saved no more than 36 months from the time of your latest activity or the time of your consent. If you want us to erase this data you can at anytime contact us and we will erase your personal data immediately.

 

Personal data for marketing purposes

In order to customize our marketing for you, showing our products and deals on both our site and those of our partners, we require the following information about you:

If you wish to receive our newsletter, access to a variety of deals, participate in customer surveys, provide feedback, or ask a question in our customer forum, we require the following information about you;

We do this only upon receiving your consent during the providing of said information. Storage time can vary depending on the situation, but it always complies with the period of time specified during the giving of consent.

 

Missue of our services

In order to prevent misuse of our services or avoid, prevent and investigate crimes against the company, we require the following information from all our customers;

  • Name
  • Address, phone number and e-mail
  • Payment information (such as the repeated use of invalid card numbers and the like)
  • Information about returns and deliveries
  • IP-number
  • Potential customer notes
  • Customer service history

This use is necessary because we have an invested interest in preventing misuse of our services and avoiding, preventing and investigating crimes against the company. Such information is saved as long as it is relevant in relation to the circumstance in question, but rarely exceeds upwards of 36 months.

 

Improving our services

In order to analyse, develop and improve our services, products and system, we ask that you consent to us having the following information about you through our cookie-banner;

  • Purchasing and user-generated data, such as click and hit history
  • Technical data surrounding devices and their settings (for ex: language, IP-address, web browser settings, time zone, operating system, and platform).
  • Information regarding how you interact with us. E.g. how you use the site, login method, where and how long you visit certain pages, response times, error codes, how you arrive to and leave the service, etc.

We do this with the obligation of processing in a way that is necessary to cater to both our and your legitimate interests by improving and developing our site, products and the offers we are able to provide. We do this through analysis on an aggregated level, i.e. that the analysis is general and not at an individual level. We save the data, as a basis for the plain text analysis, up to one year after your most recent activity. After which, we pseudonymize the information, meaning we depersonalize it so as to make the identification of the provider (you) anonymous. If, within two years of pseudonymization, you decide you want to undo the change, we can reconnect your information with your previous visits to our site and show that you are a returning customer so as to understand how returning customers generally interact with our site. If more than two years have passed since pseudonymization, we are unfortunately no longer able to revive your information and your history is cleared. Additionally, if you contact us and wish to utilize your right of termination, we will also no longer be able to recover your information.

 

WHO CAN WE SHARE YOUR DATA WITH?

In order to manage payments via the site, we use various payment services. The payment service provider is responsible for their own handling of your personal information and has separate conditions which apply for them. Some services or payment services can take place outside the EU. We never transmit any data outside the EU without taking the appropriate security measures and acquiring legal support for the transfer. YOUR RIGHTS

You have a right to know which of your personal data we use. This can be provided through a process known as a registry extract. If you have an account, you can log in to “My Account” on the top left on the website to see which data we have on you, for ex: contact information, your order history etc. If you have not registered as a member or wish to receive a complete registry extract, you can contact our customer service and we will be glad to help you!

 

We want to ensure that your personal information is correct and up-to-date. With that in mind, you have the right to request the correction of inaccurate data about you. If the information you provided changes (for ex. if you change your e-mail address, name or payment information) or if you wish to delete your account, simply contact our customer service.

 

Regarding instances involving the ways in which we process your personal data through the consent provided by you, you always have the right (at any time) to withdraw your consent regarding that processing. You will find your order number in the order confirmation email and will receive the tracking number directly from the shipping service

 

Shipping times

We ship our products on weekdays (Monday-Friday). If you order before 11 am your product will be shipped the same day. Orders, after 11 am, will be shipped on the following weekday.  

If the order is below the minimum amount for free shipping, the shipping cost is 200 NOK/20EUR/22 USD.

 

Tracking

DHL or Bring (worldwide: DHL, in Norway: Posten/Bring) will send you tracking and an SMS before the arrival of your package. With the SMS, you can choose how and when to get the product(s) delivered.

 

No hidden costs

Taxes and duties are included, so no extra cost in addition to what you see in the checkout.

When shopping online you can choose home deliver, when shipping to Norway. This gives you more flexibility, among other things. "Posten/Bring" can leave the package if you are not at home.

       Leave the package outside your home

When you order home delivery with Bring in the online store, they can leave the package even if you are not home. You decide where to put it.

How it works:

  • Delivered to the door by 8:00 a.m-5:00 p.m or by 5:00 p.m-9:00 p.m depending on area code.
  • Automatic SMS when the parcel is on its way
  • The recipient may authorize Bring to leave the parcel at the door
  • The desired delivery day can be changed when the parcel is being tracked
  • Maximum 35 kg per parcel

Home delivery (or Postens På Døren in Norwegian) cost 100 NOK.

       Home delivery In-Home

Posten now offers delivery inside if you are not at home to receive the package. In order to take advantage of the offer you must have a digital lock or a key locker with code. 

How it works:

You use the "Posten Innenfor" app to order door delivery and communicate any door code with Posten.

After the package is delivered, you will receive a confirmation via SMS. The information given to the carrier is deleted when the delivery is completed and the door is locked again.

  • Door codes are encrypted on a secure server.
  • Door codes are deleted as soon as they are used once.
  • Only the postman who delivers the package has access to the code.
  • Posten has full data storage control, encryption and deletion.

The consignment must be under 35 kg.

Delivery In-home (or Postens Innafor in Norwegian) cost 100 NOK.

RETURNS AND REFUNDS

 

We hope that you are happy with your purchase, but we are of course here to assist you, should you wish to return something. In that case, please read the following returns- and refunds policy, and feel free to reach out to us if you have any questions at returns@kastelshoes.com !

 

We provide easy returns and refunds worldwide, but free returns only applies for our costumers in Norway.

 

30 DAYS RETURN POLICY:

We accept returns with a full refund of your payment within 30 calendar days from the last item of your order was received if the returned product(s) fulfill these requirements:

  • The product(s) you return must be unused, unwashed and in its original state with hangtags on.
  • The product(s) must be in its original and unharmed packaging (shoebox).

 

RETURNS - IN NORWAY

If you choose to change the item in size or colour, we can do this easily. Changing of the size or colour is done at the same price as the original order so that there is no new payment document, provided that the price is the same. We cannot exchange for stakes so if you want a more expensive item, send an e-mail to returns@kastelshoes.com and let us know which size you would like to switch to.

  1. Send the return form + package slip together with the return shipment.
  2. Use the return note enclosed with the original shipment.
  3. The item you return must be in unused condition and in its original packaging (shoebox).
  4. Returns are delivered to the nearest post office.
  5. Exchange of goods is free*.

*We pay the return shipping for you - if you ship the return from Norway, but this requires that you use the enclosed return slip which is in the box with the item.

RETURNS – THE REST OF THE WORLD

If you wish to return your order from another country than Norway (refer to "Returns - in Norway"), the same principle applies as returning orders from Norway, but we do not cover the shipping expenses for returns in the rests of the world. In case of a return, the shipping cost is paid by the customer. We recommend shipping the item(s) with tracking in case something unforeseen should happen. 

We accept returns with a full refund of your payment within 30 calendar days from the last item of your order was received if the returned product(s) fulfill these requirements:

  • The product(s) you return must be unused, unwashed and in its original state with hangtags on.
  • The product(s) must be in its original and unharmed packaging (shoebox).

REFUNDS

  1. Fill in the return form and indicate the cause. We can send you "The Right of Withdrawal" document if you e-mail us at returns@kastelshoes.com .
  2. Add the return form + package slip with what you want to return. Feel free to use the same outer packaging you received from us or another tight packaging if you wish.
  3. Stick the return label on the box.
  4. Deliver the parcel to the nearest post office. Once we have processed the return, we will refund money to the payment method chosen at the time of booking.

We will not cover shipment if the item is returned in a different way OR if it is returned from a country other than Norway.

 

TERMS

In order to get the full amount refunded on return / cancellation right, the item must be returned in the same condition as when you received it. That is, in unused condition and in original packaging without odours and marks.

If the original packaging is damaged, the item will be considered used. Therefore, please note that if you tape and destroy a shoebox in the return shipment, the item cannot be resold and will be defined as «used items». If the item is defined as used, we consider the value reduction of the item and repay the items used value. An item without original packaging, labels or with odour / marks will be considered used and the full amount will not be refundable.

  • Shipment delivery problem

If we, against presumption, should have sent you the wrong item, we ask that you please contact us so that we can arrange to send you the correct item as soon as possible. The misdirected item is easily sent in return by you, and you must mark the return with «Shipment error».

  • Complaints

If you have been so unlucky that something wrong has happened to the item you bought from us, please contact us by mail ( returns@kastelshoes.com ) with a supplementary error message about the case, preferably with pictures if it is natural. Sometimes we do not need the item in return, so it is best if you await the submission of the defective item until you are you are notified.

 

THE RIGHT OF WITHDRAWAL

If you wish to regret your purchase, you always have 14 calendar days from the last item of your order was received. It is the right or withdrawal, also referred to as the cancellation act, that regulates duties og rights between the consumer and enterprise.

The right of withdrawal gives you as a private person the right, at no extra cost, to check the product before it is returned within the right of withdrawal. If the product is only tested or checked in the same way as you can in a general store, the customer must have the entire purchase price and shipping refunded. If the product is used (during the right of withdrawal) and this has led to a reduction in the value of the goods, the enterprise will make a deduction in the purchase price corresponding to the objectively reduced value, before the rest of the purchase price and shipping to the customer are repaid. Documentation of irresponsible and unnecessary examination of the product resulting in value reduction will be sent to the consumer by email.

You must not remove labels and the item must be returned in unused condition in original packaging with the return form. We will not cover return shipping on items that are returned in a different way.
